Marshall County Court Records

Marshall County court records document civil claims, criminal cases, traffic matters, domestic relations, and other work of Alabama trial courts. A Marshall County court records search starts by identifying whether the file belongs to Circuit Court, District Court, Probate Court, or a city municipal court. Public records can then be reviewed through an online case service, a local docket screen, or the office that keeps the original file. Searchers should distinguish a case summary from filed documents and a court setting from a final result. Restricted files and confidential data do not appear through ordinary public access.

The main online path is Alacourt ACCESS, Alabama's official on-demand trial-court records service. It covers criminal, civil, small claims, state traffic, domestic relations, and child-support cases. The public service offers name and case-number searches. A case detail can show parties, court action, status, setting dates, financial history, and a chronological case action summary. Alacourt is not a free unlimited archive. A name or case-number search costs $9.99, and a no-match response still counts as a search. Images, when offered, cost $5 for the first 20 pages and $0.50 for each later page.

Start with the case number when possible. It is more precise than a common name and is the number the Marshall County Circuit Clerk asks users to cite when contacting the court. If only a name is known, gather the full legal name and an approximate filing period. Identify whether the matter arose inside a city, involves probate, or belongs to the state trial courts. That first choice prevents a search in the wrong system.

  1. Identify the court. Circuit Court handles general-jurisdiction cases and indicted felonies. District Court handles lower civil claims, evictions, state traffic, county misdemeanors, and early felony proceedings.
  2. Open Alacourt ACCESS and choose a name or case-number search. Review the posted price before submitting a broad name query.
  3. Read the detail for the court, parties, status, settings, finances, and action summary. Buy images only if the needed document is available.
  4. For a hearing date, check the Marshall County docket for location 58. Select a setting date and enter a last name, or leave it blank for the full date.
  5. Confirm missing or uncertain data with the Circuit Clerk. Use the public computer in Guntersville, call the correct division, or request the file in person.

The Marshall County Twenty-Seventh Judicial Circuit provides the local fallback. Staff may give schedules and information found in a file, but may not give legal advice, select filing language, predict a result, or decide a deadline. City citations may remain with municipal court. Probate records use the Probate Office.

Types of Marshall County Court Records

Marshall County court records are divided by jurisdiction and subject. Circuit Civil keeps higher-value litigation. District Civil covers lower-level claims, small claims, and unlawful detainers. District Criminal keeps county misdemeanors, worthless checks, conservation and revenue tickets, ABC violations, and the first stages of felony cases. Once a felony is indicted or moved beyond grand-jury review, it proceeds in Circuit Court. Domestic relations and divorce files are routed through the Albertville division of the Circuit Clerk.

Probate Court is a separate office headed by Probate Judge Andrea Lecroy. It maintains estates, guardianships, conservatorships, adoptions, adult name changes, commitments, and public recordings. Municipal courts in Guntersville, Albertville, Boaz, and other cities keep city ordinance, city misdemeanor, and local traffic records. A city police case may therefore be absent from a Marshall County state-court query.

  • Civil files include complaints, service returns, answers, motions, orders, judgments, garnishments, and executions.
  • Criminal files may include warrants, charges, bond, pleas, motions, indictment, sentence, costs, probation, and disposition.
  • Traffic files may show the citation, court date, plea, insurance proof, fine, costs, failure to appear, and outcome.
  • Domestic files may contain service, settlement, custody or support papers, orders, a decree, and later motions.
  • Probate files may contain petitions, notices, bonds, letters, inventories, claims, reports, and orders.

Small-claims and eviction files have distinct local detail. District Civil says an individual age 19 or older may file, but a corporation must have an attorney. Eviction records may show tenant notice, service, an answer or default request, the hearing, a possession or money judgment, appeal notice, and collection entries.

What Marshall County Court Records Show

A Marshall County case detail is both an index and a timeline. It identifies the court and case type, lists parties in their legal roles, and records filings and settings. It may include money data such as fees, costs, fines, bond, restitution, or post-judgment collection. A status label is useful, but the action summary and final order give more context. “Disposed” means the court has ended that case or charge. It does not by itself say whether a criminal defendant was convicted or a civil plaintiff won every claim.

FieldWhat It Shows
Basic case informationCase number, category, court, division, and filing date.
PartiesPlaintiff and defendant, State and defendant, petitioner and respondent, or probate roles.
Court actionFilings, rulings, service, motions, hearings, trial, judgment, and appeals.
Case statusActive, set, disposed, dismissed, defaulted, appealed, transferred, sealed, or expunged when visible.
Setting datesDate, time, location, judge, and hearing or trial type.
Financial historyCosts, fines, payments, bond, restitution, garnishment, or execution.
DocumentsPleadings, notices, motions, orders, judgments, affidavits, and available paid images.

Read roles and dates with care. A complaint starts many civil cases. Service is legal delivery of papers. A motion asks the judge to act. A judgment resolves a civil claim, while a disposition records the outcome of a criminal charge or case. A later appeal, amended order, or expungement can change what an earlier entry means.

Marshall County Court Records Access

Alabama Code Section 36-12-40 gives Alabama residents a right to inspect and copy public writings unless another law makes them exempt. Section 36-12-41 requires a custodian to provide a copy on proper request and payment of a reasonable fee. Court access also follows Alabama Rule of Court-Record Privacy and Confidentiality 104, which treats records as accessible unless law, rule, order, sealing, or confidentiality restricts them.

The right to inspect does not make each online service free or each file available on the web. Marshall County has a paid portal, a free limited docket, a public computer, and direct clerk contact. Identify the case number, exact document, and whether a plain or certified copy is needed. Section 36-12-44 addresses request timing and clarification.

The official inspection-right source illustrates the law behind ordinary Marshall County public records.

Note: Online access is convenient; the originating clerk remains the source for a certified or corrected Marshall County court record.

Restricted Marshall County Court Records

Juvenile legal and law-enforcement files are confidential under Alabama Code Section 12-15-133. Public searches should not reveal juvenile delinquency, dependency, or child-in-need-of-supervision files. Adoption hearings are also confidential. Mental-health cases, sealed files, and protected personal data may be withheld or redacted. Public copies should not expose full Social Security numbers, financial-account numbers, or protected minor data.

An expungement can remove an eligible criminal matter from ordinary public access, but may preserve access for courts, law enforcement, licensing bodies, or authorized users. Eligibility varies with charge, outcome, waiting period, prior history, and objections. A person with an order whose old record still appears should contact the clerk or agency and provide a certified copy. Access to a sealed record generally requires a legal basis and, where applicable, a court order.

The Alabama public-record copy provision is a useful companion to the access rules.

The main office is inside Marshall County Courthouse, and Guntersville has the public access computer for Circuit and District file research. Albertville routes divorce, child support, protection-from-abuse, and juvenile matters. Call before travel when the division is unclear. Bring the case number, party name, filing period, and document title. Ask whether the copy must be certified. Probate files require the Probate Office at 425 Gunter Avenue, Suite 110, Guntersville, phone (256) 571-7764. Sheriff Phil Sims leads the Sheriff's Office next to the courthouse, but sheriff and jail records remain distinct from the Circuit Clerk's court files. Municipal files come from the city court. Appeals may be searched through the Alabama Appellate Courts Public Portal, which covers public documents filed or issued on or after March 20, 2022.

The official appellate search provides a separate path for appeals from Marshall County cases.

Marshall County Record Request Timing

A direct request works best when it is narrow. Give the custodian enough detail to identify the file and state whether inspection, a plain copy, or a certified copy is needed. The office may clarify an unclear request and charge a reasonable fee. Court files follow court-record rules, while non-court county records may use the Commission form, which asks for identification and a specific description.

The Alabama request-timing statute documents current public-officer duties.
